DOG BITE LAW IN ONTARIO
In Ontario, the Dog Owners Liability Act R.S.O. 1990, c. D.16 makes the owner of a dog liable for damages resulting from a bite or attack by the dog on another person or domestic animal. Where there is more than one owner of a dog that bites in Ontario, the law makes all owners jointly and severally liable for the damages caused by the dog. Such liability of the dog owner or keeper does not depend upon knowledge of the propensity of the dog or fault or negligence on the part of the owner or keeper. Liability can still be maintained even where there is little warning or where the owner or keeper is not present at the scene of the attack. However, the exception to liability can be where a person is bitten by a dog on a person’s property while committing a criminal act.
STEPS TO TAKE FROM A DOG BITE INJURY
Anyone bitten or attacked by a dog should immediately:
- Contact and seek medical attention
- Ensure the dog has had all the necessary shots by asking the owner
- Obtain the name and address of the owner of the dog and keeper(s)
- Take photographs of the injured area
- Collect all bills, receipts and other evidence of expenses arising from the attack
